  1. Recently, another Shareware CD-ROM publisher in New York State has been involved
  2. in a Federal copyright lawsuit.
  3.  
  4. We here at PHOENIX Publishing have been able to secure actual court transcripts
  5. pertaining to this case. During these hearings, we were able to uncover some
  6. wrongdoings which have not been made public until now. We would like you to at
  7. least look at a few small files called NIGHT1 through NIGHT3. These files are
  8. condensed excerpts from almost 4 MEGABYTES (3000 pages) of files found in our
  9. root directory named NIGHTOWL.XXX. Each of these NIGHTOWL files are in an easy
  10. to read ASCII file format, so any text reader can view them. NIGHTOWL.ZIP is a
  11. single, complete file which has all of these ASCII files which allows it to be
  12. easily sent by modem to other interested parties. NIGHTOWL.KEY is a short file
  13. written as a guide to each of these larger, full length text files. A copy of
  14. this file is found a few lines below for your convenience.

  32.       NIGHT1 is an introductory file, a cover letter showing our validitity of 
  33.              our files presented here. It is a copy of our Main Cover Page used
  34.              in this case.

  36.       NIGHT2 is a file condensation from testimony given by Richard Graham
  37.              concerning his relationship with C.A.R.R.S., & Night Owls. It is
  38.              interesting to notice how often he contradicts himself.
  39.  
  40.       NIGHT3 is a condensed file from testimony given by Ken Helinski. This file
  41.              reflects his relationship with Richard Graham.
  42.  
  43. To help clear any confusion, we would like to identify our key people mentioned 
  44. here. First, Richard Graham is our Plaintiff. Larry James is our defendant. Ken
  45. Helinski is a witness testifying on behalf of Larry James. Mr. Kitchen is an
  46. attorney representing Richard Graham while Mr. Ostrowski is representing Larry
  47. James.

  49. As of this date, April 10th, 1994, a decision has not yet been handed down in 
  50. this case. As soon as it becomes available, we will post it on BBS networks &
